1. Agreement to these terms
These Terms of Use are an agreement between you and Ghost Kitchen (“Ghost Kitchen,” “we,” “us,” or “our”). They apply when you visit our websites, create or use an account, join a preview or playtest, or use an online feature or service that links to these terms (collectively, the “Services”).
By accessing or using the Services, you agree to these terms. If you use the Services for an organization, you represent that you have authority to bind that organization, and “you” includes the organization. If you do not agree, do not use the Services.
Software we distribute is also governed by the Software EULA. Purchases, subscriptions, and publishing programs may have additional terms presented before you opt in. If a product-specific written agreement conflicts with these terms, the product-specific agreement controls for that subject.
2. Eligibility and minors
The Services are intended for a general audience and are not directed to children under 13. You may not create an account or provide personal information through the Services if you are under 13.
If you are under the age of legal majority where you live, a parent or legal guardian must review these terms with you and authorize your use. You must have legal capacity to enter any paid creator program, accept a sponsored brief, or make another binding commercial commitment.
If we learn that an account was created by a child under 13, we may close the account and delete associated personal information, subject to legal, security, and integrity requirements. A parent or guardian may contact us at hello@ghostkitchen.studio.
3. Accounts and credentials
You must provide accurate account information, keep it reasonably current, and protect your password, access code, device authorization, and other credentials. Do not share credentials except through a feature we expressly provide for that purpose.
You are responsible for activity performed through your account unless caused by our failure to use reasonable security. Tell us promptly at hello@ghostkitchen.studio if you believe an account or credential has been compromised.
Display names and other identifiers must not impersonate another person or organization, violate another party’s rights, mislead people about affiliation, or contain abusive or unlawful material. We may reclaim or change identifiers when reasonably necessary to address those issues.
4. Development builds and changing services
Some or all Services may be alpha, beta, experimental, invitation-only, incomplete, or available for a limited test. Pre-release Services may contain defects, lose or reset progress, change without notice, or stop being available.
We may add, remove, rebalance, suspend, or discontinue features, worlds, content, access methods, or compatibility as the products develop. We do not promise that a preview will become a commercial product or that data from one build will carry into another.
Do not rely on a pre-release Service for production-critical work or as the only copy of important content. Keep your own source files and backups.
5. Acceptable use
Use the Services lawfully and in a way that respects other people, the integrity of the platform, and the creative work it hosts. You may not use or attempt to use the Services to:
- harass, threaten, exploit, defraud, stalk, dox, or abuse another person;
- upload or distribute unlawful, infringing, deceptive, hateful, sexually exploitative, or malicious material;
- probe, scan, bypass, disable, or interfere with authentication, authorization, rate limits, moderation, security controls, networks, clients, or servers;
- introduce malware, destructive code, hidden miners, credential theft, or content intended to compromise another system;
- cheat, automate play in an unauthorized way, manipulate creator metrics, farm engagement, duplicate rewards, or falsify transactions or provenance;
- scrape, harvest, or collect data or content at scale except through an interface or permission we provide;
- reverse engineer or access non-public systems except where applicable law expressly permits it; or
- help another person do any of the above.
6. Your content and communications
You retain ownership of content you create and submit, subject to any rights held by others and any separate agreement you accept. You give us a non-exclusive, worldwide, royalty-free license to host, copy, process, transmit, display, and technically adapt content only as reasonably necessary to provide, secure, review, and improve the feature where you submitted it.
That basic service license ends when the content is deleted from active systems, except for reasonable backup, security, legal, and audit retention. Content submitted to an Asset Store or other publishing program may have additional licenses and lifecycle rules presented before submission.
You are responsible for your content and must have the rights and permissions needed to submit it. Do not upload confidential information unless a feature or written agreement expressly calls for it.
7. Ghost Kitchen materials
The Services, software, visual systems, worlds, characters, text, audio, artwork, code, logos, and other materials provided by Ghost Kitchen or our licensors are protected by intellectual-property and other laws. Except for the limited right to use the Services under these terms and the Software EULA, no rights are transferred to you.
Ghost Kitchen, Pivox, Mapper, Skin, associated logos, and trade dress are names and marks of Ghost Kitchen or its licensors. Do not use them in a way that implies sponsorship, endorsement, or official status without written permission.
8. Credits, virtual items, and future commerce
Unless separate purchase terms say otherwise, subscriptions, access rights, downloadable benefits, and other digital features are limited licenses for use with the applicable Service. They are not legal tender, stored value, a bank account, or an investment.
No revenue share, royalty, employment, partnership, or payment obligation exists unless Ghost Kitchen and the eligible creator enter applicable publishing, monetization, or written project terms.
For paid creator tools, the price, billing interval, renewal, seat quantity, trial, tax, cancellation, and refund terms shown at checkout also apply. Lemon Squeezy is the primary merchant of record and legal seller for those purchases. If Ghost Kitchen activates its documented Paddle fallback, Paddle becomes the legal seller for transactions made through that checkout.
9. Third-party services and open-source software
The Services may interoperate with operating systems, storefronts, hosting providers, storage providers, payment providers, or websites we do not control. Their terms and privacy practices apply to their services. We are not responsible for third-party services, but these terms do not limit rights you may have against them.
Software may include open-source components governed by their own licenses. Those licenses control for the relevant components, and nothing in these terms reduces rights granted under them.
10. Moderation, suspension, and termination
We may investigate suspected violations and may remove content, restrict features, suspend credentials, preserve relevant records, or close accounts when reasonably necessary to protect people, rights, the Services, or legal obligations. Where practical, we will consider context and use proportionate measures.
You may stop using the Services at any time and may ask us to close your account. Closing an account does not unwind completed transactions, remove content already lawfully distributed to others, erase immutable publication or audit records where retention is necessary, or end provisions that by their nature should survive.
11. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” GHOST KITCHEN DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR COMPATIBLE WITH EVERY SYSTEM, OR THAT CONTENT OR DATA WILL NEVER BE LOST.
Some jurisdictions do not allow particular warranty exclusions. In that case, the exclusions apply only to the extent permitted, and nothing in these terms limits non-waivable consumer rights.
12. Limits of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GHOST KITCHEN AND ITS TEAM, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOSS OF GOODWILL, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID GHOST KITCHEN FOR THE RELEVANT SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limits do not apply where prohibited, including liability that cannot lawfully be limited for fraud, willful misconduct, death, personal injury, or violation of non-waivable consumer rights.
13. General terms
You may not transfer these terms or an account without our written consent. We may assign these terms as part of a reorganization, financing, merger, acquisition, or transfer of the relevant business. If one provision is unenforceable, it will be limited to the minimum extent necessary and the rest will remain in effect. A delay in enforcement is not a waiver.
These terms, the Privacy Notice, the Software EULA when applicable, and any product-specific terms presented to you form the agreement for the Services. They do not create employment, agency, partnership, franchise, or fiduciary relationships.
We may update these terms as our products or legal obligations change. We will post the updated version and effective date and provide additional notice when required. Continued use after an update becomes effective means you accept the revised terms.
